DISCIPLINE COMMITTEE OF THE ONTARIO COLLEGE OF TEACHERSBETWEEN:ONTARIO COLLEGE OF TEACHERSandGORDANA ANNE STEFULICNOTICE OF HEARINGTHE ANALYSIS COMMITTEE OF THE ONTARIO COLLEGE OF TEACHERS, pursuant to section 26, subsection (5) of the Ontario College of Teachers Act, 1996 (the Act), Laws of Ontario, 1996, page 12, has directed that the matter hereinafter explained about the conduct or activities of Gordana Anne Stefulic, Certificate No176236, be known the Discipline Committee of the Ontario College of Teachers.IT IS ALLEGED that Gordana Anne Stefulic is guilty of professional misconduct as outlined in subsections 30(2) and 40(1.1) of the Act in that:(a) she failed to steadfastly keep up the requirements of the job, contrary to OntarioRegulation 437/97, subsection 1(5)(b) she abused a student or students physically, sexually, verbally, psychologically or mentally, contrary to Ontario Regulation 437/97, subsection 1(7) and engaged in sexual abuse of the student or students of a dynamics outlined in parts 1 and 40 (1.1) of the Act(c) she failed to comply with the Training Act, Revised Statutes of Ontario, 1990, part E.2, and especially section 264(1)(c) thereof or the Regulations made under that Act, contrary to Ontario Regulation 437/97, subsection 1(15)(n) she committed acts that having regard to most of the instances Might reasonably be regarded by members as disgraceful, dishonourable or unprofessional, contrary to Ontario Regulation 437/97, subsection 1 and(e) she engaged in conduct unbecoming a Part, contrary to Ontario Regulation437/97, subsection 1(19).PARTICULARS OF THESE ALLEGATIONS ARE THE FOLLOWING:1. Gordana Anne Stefulic (the Participant) is just a member of the Ontario University ofTeachers.2. At-all material times, the Member was utilized by the Toronto District School Board(the Board) as a Key at [XX] School (the School) in Ontario.3. Throughout The 2007-2008 academic year, the Participant granted and/or authorized Scholar No. 1and Student No. 2, two male students of the Table under the age of sixteen years, entryand/or access to her Facebook site and by so doing, helped Student No. 1 and StudentNo. 2 to access inappropriate and/or watch material including:(a) A final impression of the male person with out a shirt, wearing a Speedo swimsuit and called, Meal of Your Day(w) A drawing showing a naked girl depicting her breasts and a naked man holding a sequence that has been tied to his well endowed penis.4. Through The 2007-2008 academic year, the Member,(a) permitted a student and/or students to have access to some personal notebook computer which she knew or ought to have known contained images of a pornographic nature or sexual nature, which appeared to reflect young teenage males(t) permitted a student and/or students to have access to the class computer which she knew or ought to have known contained pornographic images and/or violent animation images and/or images of naked figures(c) required and/or granted Pupil No. 3, Scholar No. 4 and Student No. 5, male students, to provide her a massage and(n) made no initiatives to stop or reduce a pupil and/or individuals from seeking to rub her back.THE DISCIPLINE COMMITTEE WILL HOLD A HEARING pursuant to parts 30 and 32 of the Ontario College of Teachers Act, 1996, to determine whether the claims are true and whether Gordana Anne Stefulic is guilty of professional misconduct. A replica of the Principles of Procedure of the Discipline Committee and of the Fitness to Practise Panel will be supplied upon request.THE CONTROL COMMITTEE WILL MEET on Thursday, February 14, 2013 at 9:00 a.m. to create a date for the hearing of this matter. The Board will meet on the 12th floor of the offices of the Ontario College of Teachers at 101 Bloor Street West, Toronto, Ontario.YOU HAVE ENTITLEMENT TO BE THERE ON THE ABOVE MENTIONED DATE AND AT THE HEARING AND TO BE REPRESENTED BY APPROPRIATE COUNSEL.If you want, you or your legal counsel may contact Faculty Counsel to discuss the scheduling of a hearing date to ascertain whether a date for the hearing could be agreed-upon.
